According to court documents he obtained Us Weekly On Tuesday, October 28, Bernad filed for sole legal and physical custody of his 19-month-old son, Somi. Bernad asked Sia to “monitor the visit” three times a week. Sia, 49, was also required to “submit to random and regular drug testing” and a sobriety test before each supervised visit.
Bernad claimed that Sia “posed a serious and immediate danger” to their son. The pop star was allegedly secretly hospitalized for two weeks last September, and tested positive for barbiturates and benzodiazepines.
“Sia is an unfit and unreliable mother who suffers from drug abuse and addiction, making her unable to provide safe or stable care for Somi,” Bernard claimed in his announcement. “I am the only safe and reliable parent to our son. I am a doctor, young, healthy, and have no criminal history or drug or alcohol addiction problems.”

Bernad is also seeking $77,245 a month in child support, claiming he gave up his job as a doctor after marrying Sia in 2023 and instead opened a ketamine clinic at her request.
Sia filed a response to Bernad’s petition on Tuesday, criticizing his allegations. Sia “has been sober for more than six months,” the documents stated, adding that the Grammy winner “repeatedly consented to drug testing and requested that she and Dan undergo regular drug testing.” Sia claimed that Bernad “refused to take regular drug testing.”
“It is true that I have struggled with drug and alcohol problems for over fifteen years. I have been completely sober for over six months and working on my program which includes weekly testing and a sobriety companion,” Sia wrote in her announcement. “My recovery has been a cornerstone of my life and one of the main reasons I chose to separate from Dan, whose continued involvement in nightlife and a recreational lifestyle of substance abuse was not compatible with a healthy environment for our child.”
Sia slammed her ex-husband for trying to “weaponize” her “past sobriety journey” against her as she sought full custody. She also claimed that Bernad was subject to supervised visits with their son due to the alleged child pornography investigation.
“I have been informed that Dan is under investigation by the Los Angeles Police Department (LAPD) and the Department of Child and Family Services (DCFS) for allegations of child pornography,” Sia claimed. “I requested and Dan agreed that his visit to Sumi would be in the presence of professional detention monitors.”
Sia stated that the investigation was “closed” and that the results were “inconclusive.”
